Terms & Conditions

These terms are an agreement between you and Vykon Coaching ("VYKON", "we", "us"), the provider of the VYKON Hub coaching platform at hub.vykon.us. By creating an account or continuing to use the Hub, you agree to these terms. If you are signing up on behalf of a branch or company, you confirm you have authority to bind that organization. If you are signing up for yourself, you confirm you are of legal age.

What the Hub is

The VYKON Hub is a subscription software platform for mortgage professionals and their coaches. It includes life and business planning tools, a daily activity tracker, production reporting, follow-up and partner tracking, an AI coaching assistant, and printable reports. We may add, change or retire features over time.

Your account

• Keep your login credentials confidential; you are responsible for activity under your account.
• Provide accurate information and keep it current.
• Branch, coaching company and white label plans include a set number of seats. Adding seats beyond your plan requires an upgrade.

Acceptable use

You may not:

• Use the Hub for anything unlawful, fraudulent or abusive, including spam.
• Infringe anyone's intellectual property or upload content you have no rights to.
• Interfere with security — no malware, probing, scraping, or circumventing plan limits.
• Reverse engineer, resell or redistribute the Hub or its content.
• Upload consumer information you are not permitted to store or process, or use the Hub in a way that violates NMLS, TILA, RESPA, UDAAP, state licensing rules, or your employer's compliance policies.

You are solely responsible for the accuracy and compliance of any marketing, disclosures, license numbers or client-facing material you produce or print from the Hub. Branding fields (photos, logos, NMLS IDs, disclaimers) are yours to control, and reviewing them for compliance before use is your responsibility.

AI features

The VYKON Coach and other AI features generate suggestions from the information in your account. Outputs may be incomplete or inaccurate, are for general coaching and educational purposes only, and are not financial, legal, tax, underwriting or compliance advice. Verify anything you rely on. You are responsible for your prompts, the content you provide, and how you use the outputs. We may filter, refuse or remove content, and may suspend accounts for repeated misuse.

Licence and ownership

We grant you a limited, non-exclusive, non-transferable right to use the Hub within the plan you have selected. VYKON retains all ownership and intellectual property in the platform, the VYKON Success System methodology, its content, and its branding. You keep ownership of the content you enter, and grant us a limited licence to host and process it solely to provide the service.

Payment and subscription terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, currency, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically each billing period until cancelled. Where a free trial is offered, a payment method is required and billing begins when the trial ends unless you cancel first. See our refund policy for our money-back guarantee.

Service level

We work to keep the Hub available and reliable, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Liability

To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect, consequential or special damages, including lost profits, lost loans, lost data or lost goodwill. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it. You agree to indemnify us for claims arising from your content, your unlawful use, or your breach of these terms.

Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. When access ends you will have a reasonable window to export your data, after which it may be deleted.

General

These terms are governed by the laws of the State of Utah, USA, and disputes will be heard in the courts located in Salt Lake County, Utah. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. If we change these terms materially, we will let you know in the Hub or by email.
